Welcome to Kenekts Global, LLC
By accessing or using our website (kenekts.com), programs, courses, downloads, or services (the “Services”), you agree to the terms below. This agreement is designed to protect both your experience and our company. Please read it carefully before using any part of the site or making a purchase. If you do not agree, do not use the site or any of its Services.
These Terms & Conditions (“Terms”) form a binding agreement between you and Kenekts Global, LLC (“Kenekts,” “we,” “us,” or “our”).
Definitions
For clarity, we use the following definitions throughout these Terms:
“The Oracle Table” refers to Kenekts’ AI fluency methodology and the suite of courses, tracks, and resources delivered through the Kenekts platform.
“The Oracle Table Method” refers to the paid bundle of three universal capability courses—THOUGHT (Strategic AI Fluency), WORD (Creative AI Fluency / Creative Studios Library), and ACTION (Deployment Lab)—plus one Track of the student’s choice.
“Courses” refers to the three self‑paced educational programs that make up The Oracle Table Method:
THOUGHT (Strategic AI Fluency) — six AI platform setups, prompting skills, and troubleshooting.
WORD (Creative Studios Library) — seven creative AI platform tutorials, available as a supplemental resource.
ACTION (Deployment Lab) — Custom GPTs, Google Gems, Claude Projects + Skills, app building, and platform connections.
“Tracks” refers to specialized applied transformation programs (such as Executive Positioning, Wisdom Monetizer, or The Presence) that apply The Oracle Table methodology to specific professional challenges. Each Track follows an internal THOUGHT → WORD → ACTION structure applied to the student’s real situation.
“The Foundation” refers to the free introductory course (AI Foundations) that covers AI philosophy, landscape, and orientation.
“Creative Studios Library” refers to the supplemental creative tools resource library (WORD) included with qualifying purchases.
“Deployment Lab” refers to the ACTION course that teaches universal deployment skills including Custom GPTs, Google Gems, Claude Projects + Skills, and app building. Included with qualifying purchases.
“Coaching Sessions” refers to 1:1 sessions with Kenekts staff, including Power Sessions and premium coaching engagements.
“The Setup” refers to a phased strategic planning engagement that includes personalized assessment, custom implementation plan, and direct coaching from Kenekts leadership.
“Prescriptive Machine” refers to the monthly subscription diagnostic and recommendation service.
“Enterprise Engagements” refers to custom team training, advisory, or consulting engagements scoped and priced individually.
Eligibility & Child Privacy
Minimum Age Requirement
Kenekts.com and our Services are intended for users who are 18 years or older. By using this site or enrolling in any of our programs, you confirm that you meet this age requirement and have the legal capacity to enter into this agreement.
If You Are Under 18
If you are between 13 and 17 years old, you may only use this site and enroll in any of our programs with the consent and active supervision of a parent or legal guardian. Certain sections of our site or programs may not be accessible to users under 18.
Children Under 13
Kenekts does not knowingly collect, use, or disclose personal information from children under the age of 13. If we learn that we have collected personal data from a child under 13 without verified parental consent, we will delete that information promptly. If you believe we may have data from or about a child under 13, contact us at hellothere@kenekts.com.
Changes to These Terms
We may update these Terms from time to time. If we do, we will update the “Last Updated” date at the bottom of this page. New terms apply as soon as they are posted. It is your responsibility to review these Terms periodically. Your continued use of the site or Services after changes are posted constitutes your acceptance of the updated Terms.
Privacy and Data Use
Your use of kenekts.com and our Services is also governed by our Privacy Policy, which describes how we collect, store, and use your data. By using the site or our Services, you agree to the Privacy Policy as well.
We use automation tools including AI platforms, Zapier, Typeform, Kajabi, and other course delivery and communication platforms to enhance your user experience. By participating in our programs, you acknowledge and consent to your inputs being processed through these services. We do not claim ownership of your responses, but we may use aggregated, anonymized data to improve our offerings, measure outcomes, and refine our methodology.
You are responsible for the data you choose to provide. You should not upload or share highly sensitive personal, financial, or confidential third‑party information unless you understand and accept the risks associated with the relevant third‑party tools.
Email Communications & Newsletter
By providing your email address on our Website, enrolling in a program, or opting in to Tech Tea or any Kenekts email list, you agree to receive educational content, service‑related messages, and occasional promotional communications from us. You can unsubscribe from marketing emails at any time by clicking the unsubscribe link in any email or contacting hellothere@kenekts.com. Unsubscribing from marketing emails does not affect transactional or service emails related to your purchases, account, or security. Our collection and use of your email information is governed by our Privacy Policy.
Products and Services
The Oracle Table Method
The Oracle Table Method is a self‑paced AI fluency program consisting of:
THOUGHT: Your AI Fluency Foundation — Strategic AI Fluency across 6 platforms (setups, prompting skills, troubleshooting).
WORD: Your Creative Studio / Creative Studios Library — Access to 7 creative AI platform tutorials, available as a supplemental resource throughout your program.
ACTION: Your Deployment Lab — Deployment skills including Custom GPTs, Google Gems, Claude Projects + Skills, app building on Lovable, and platform connections.
One Track of your choice — such as Executive Positioning, Wisdom Monetizer, The Presence, or other available Tracks. Each Track follows a THOUGHT → WORD → ACTION structure applied to your specific situation.
AI Foundations (Free)
AI Foundations is a free introductory course covering AI philosophy, landscape, and orientation. It is available to all registered users and serves as the recommended starting point before enrolling in The Oracle Table Method.
Additional Tracks
Students who complete their initial Track may purchase additional Tracks at the then‑current price. Additional Tracks include continued access to the three Method courses (THOUGHT, WORD, ACTION) at no extra charge.
Power Sessions
Power Sessions are 90‑minute 1:1 coaching sessions available to any student or non‑student. They may be purchased independently or as a supplement to course enrollment.
Prescriptive Machine
Prescriptive Machine is a monthly subscription service providing diagnostic assessments, personalized recommendations, and updated tools. You may cancel at any time with no penalty. Cancellation takes effect at the end of the current billing period; no refunds are provided for partial billing periods.
The Setup
The Setup is a phased strategic planning engagement with direct coaching from Kenekts leadership. It includes personalized assessment, a custom implementation plan, and scheduled coaching sessions. Scope and deliverables vary by engagement level and will be described in a separate proposal, statement of work, or agreement.
Enterprise Engagements
Enterprise Engagements are custom team training and consulting engagements. Pricing, scope, deliverables, and any bespoke terms are defined in separate Statements of Work (“SOW”). To the extent there is a conflict between these Terms and an SOW for an enterprise client, the SOW controls for that engagement. Enterprise Engagement refund terms are governed by the individual SOW and are not subject to the standard refund policy below.
Track Selection and Switching
Upon purchase of The Oracle Table Method, you will select one Track. Your selection determines which specialized curriculum and workbooks you receive.
You may request a one‑time Track switch within 14 days of purchase, provided you have not completed more than 25% of your originally selected Track. Track switch requests should be sent to hellothere@kenekts.com with your name, email, purchase details, and requested new Track. After 14 days or 25% completion (whichever comes first), your Track selection is final.
Payments & Billing
Payment Methods
Payments for our programs and Services are processed through third‑party payment processors, including Kajabi Payments and their underlying processors (such as Stripe), as well as any other providers we may use from time to time. By making a purchase, you authorize us and our payment processors to charge your chosen payment method for all fees associated with your purchase.
Each payment processor has its own terms and privacy policy. By completing a purchase, you agree to comply with those terms in addition to these Terms.
Pricing and Plans
All prices are listed in U.S. dollars unless otherwise stated. We reserve the right to change pricing at any time. Any such changes will not affect purchases already completed but will apply to future purchases.
If a product offers installment or payment plans, selecting a payment plan is a commitment to pay the full program fee, subject only to the applicable satisfaction guarantee and refund policy for that product.
Failed Payments
If a payment is declined, rejected, or otherwise fails:
Our payment processor (such as Kajabi Payments) may automatically retry the payment according to its internal rules.
If payments remain unsuccessful, your access to the relevant course, program, community, or subscription may be suspended or revoked.
You remain responsible for paying any amounts owed, except as otherwise provided by an approved refund under our refund policy.
We reserve the right to refer overdue accounts to collections or to pursue other legal remedies where permitted by law.
Chargebacks and Payment Disputes
You agree to contact us at hellothere@kenekts.com and use our stated refund and dispute process before initiating a chargeback with your bank or payment provider.
If you initiate a chargeback instead of following our process:
We may immediately revoke your access to all purchased programs, communities, and Services.
We may provide our payment processor (such as Kajabi Payments/Stripe) with documentation of your enrollment, progress, access, and refund eligibility to contest the dispute.
If a chargeback is resolved in our favor or deemed invalid, you remain responsible for any associated fees and unpaid balances, where permitted by law.
Satisfaction Guarantee and Refund Policy
The Oracle Table Method
We stand behind The Oracle Table methodology. If you complete the work and do not see the value, we offer a satisfaction‑based refund under the following conditions:
Refund Eligibility Requirements:
Refund requests must be submitted within 30 days of purchase.
You must demonstrate completion of the THOUGHT Foundation, including verified setup of all six AI platforms and submission of the THOUGHT workbook.
Platform completion is verified through our learning management system (currently Kajabi).
Refund requests from students who skipped the THOUGHT Foundation or did not complete the required platform setups will not be approved.
To request a refund, email hellothere@kenekts.com with the subject line “Refund Request” and include your completed workbook and any requested proof of completion. Approved refunds will be processed within 14 business days. Refunds will be issued to the original payment method where possible.
Power Sessions
All Coaching Session purchases (including Power Sessions) are final. We require at least 24 hours’ notice to reschedule. You may reschedule one time only. Additional reschedule requests or missed sessions (including no‑shows) will be forfeited. No refunds are provided for canceled or unused sessions.
The Setup
The Setup is a phased engagement. Each phase is billed separately and is non‑refundable once coaching sessions within that phase have been delivered. Unused coaching sessions within a purchased phase expire 90 days from the date of purchase. Rescheduling and cancellation policies for individual sessions follow the same terms as Power Sessions above.
Prescriptive Machine
You may cancel Prescriptive Machine at any time. No refunds are provided for partial billing periods. Cancellation takes effect at the end of the current billing period, and you will retain access until that date.
Enterprise Engagements
Refunds and payment terms for Enterprise Engagements are governed by the specific SOW and are not subject to the standard refund policy in this section.
Free Products
AI Foundations and any other free resources are provided at no cost and are not eligible for refund claims.
Intellectual Property
All content on kenekts.com and within The Oracle Table—including text, videos, audio, downloads, logos, templates, courses, prompts, frameworks, workbooks, agent configurations, and related materials—is owned by or licensed to Kenekts Global, LLC and is protected by intellectual property laws.
You are granted a limited, non‑exclusive, non‑transferable license to access and use the content for your personal or internal business use only. You may not:
Copy, resell, share, or publicly distribute our content in any form.
Create competing products or services based on our materials, frameworks, or methodology.
Reproduce, distribute, or repurpose any Oracle Table prompts, templates, or agent configurations for commercial use without our prior written consent.
Share login credentials or provide access to your account to any other person, including clients, colleagues, or team members, unless explicitly permitted in writing.
Your purchase does not transfer ownership of any materials. The outputs you create using our methodology (your workbooks, AI agents, creative assets, and implementations) belong to you. The underlying methodology, prompts, frameworks, and course materials used to create them belong to Kenekts.
Confidentiality
In the course of Coaching Sessions, The Setup, Tracks, Enterprise Engagements, or community participation, you may share sensitive or confidential information about yourself, your business, or your organization.
We agree to treat your non‑public information as confidential and not to disclose it to third parties except:
As required by law,
To our internal team, subcontractors, or service providers who need the information to support you and who are bound by confidentiality obligations, or
In anonymized or aggregated form that does not personally identify you.
You agree:
Not to share or disclose proprietary strategies, internal documents, or non‑public materials we provide to you outside of the context of our programs.
Not to share other participants’ sensitive information or stories outside of the program, including details shared in group calls, community spaces, or live events.
We may request permission to use your testimonials, feedback, or success stories in our marketing. You may decline or withdraw permission where required by law.
Program Participation
When you enroll in an Oracle Table course or Track, or participate in any Kenekts program:
You agree to respect our learning community and methodology.
You agree not to share, distribute, or repurpose our materials except as allowed in the Intellectual Property section.
You understand that course content is self‑paced and accessible for the duration specified in the Access Duration section below (subject to payment and these Terms).
You are responsible for completing the recommended sequence to achieve optimal results.
Recommended Program Sequence
For the best experience and outcomes, we recommend completing the program in this order:
AI Foundations (free) — orientation and philosophy.
THOUGHT: Your AI Fluency Foundation — six AI platforms set up with prompting skills.
ACTION: Your Deployment Lab — Custom GPTs, Gems, Claude Projects, app building.
Your Track — THOUGHT → WORD → ACTION applied to your specific situation.
WORD: Your Creative Studio — available anytime as a supplemental resource.
Students who choose to complete courses or modules out of the recommended sequence do so at their own discretion. Deviating from the recommended sequence may affect your results and is considered when evaluating refund eligibility.
Responsible Use of AI and Content Creation
During your time in The Oracle Table and related programs, you will work with multiple AI platforms (including but not limited to ChatGPT, Claude, Gemini, Perplexity, NotebookLM, Microsoft Copilot, and various creative AI tools). You may also build custom AI agents and configurations as part of the ACTION Deployment Lab and your Track’s ACTION module. Some students may explore developer tools and AI‑assisted coding environments (such as Claude Code, GitHub Copilot, Cursor, or similar) as their skills advance.
You are solely responsible for the content you create using these tools and the agents you build—both during and after the program. This includes AI‑generated analysis, copy, images, voice clones, digital avatars, websites, and agent outputs.
You agree that you will not use any content or agents created through our methodology to:
Mislead, impersonate, or deceive others.
Plagiarize or infringe on others’ intellectual property rights.
Violate privacy, publicity, or confidentiality rights.
Cause harm, harassment, or discrimination.
Engage in unlawful or unethical activities.
Kenekts is not responsible for how you choose to use any tools, prompts, agents, or materials provided once the program ends. We provide guidance and best practices, but it is your responsibility to ensure your public‑facing content and deployed agents are accurate, respectful, and lawful.
Access Duration
All enrolled students receive access to their purchased courses, Tracks, and supplemental materials for the lifetime of the Kenekts learning platform, subject to these Terms and successful payment.
“Lifetime” refers to the active lifespan of the platform. As long as the Kenekts platform is supported and operational, your purchased content will remain accessible to you.
We reserve the right to update, modify, or improve course content over time. When content is updated, you will receive access to the updated version at no additional charge.
We may discontinue or replace specific modules, features, or tools where necessary (for example, if a third‑party platform ceases to exist or changes materially).
Free content (such as AI Foundations) may be modified, moved, or removed at our discretion.
Access may also be suspended or terminated as described in the Termination & Suspension section below.
Community & Conduct
If you participate in any group chats, comment sections, communities, or virtual events, you agree to:
Be respectful and kind.
Avoid hate speech, harassment, spam, or discriminatory behavior.
Stay on topic and contribute constructively.
Use your real name or assigned identifier.
We reserve the right, in our sole discretion, to remove or suspend any user who does not follow these guidelines, without refund, where permitted by law.
Use of Kenekts Content to Create New Communities or Programs
We support your growth and creativity, and we celebrate when your Kenekts experience inspires you to build your own online presence, community, or offering. However, you may not use Kenekts intellectual property, including but not limited to our frameworks, course structure, branded language, AI prompt packs, agent configurations, or course materials, to create a derivative or competing product, service, or brand.
You also may not position your efforts as an extension, continuation, or “chapter” of the Kenekts brand. Doing so may result in legal action, including requests to cease and desist, termination of access, and other remedies.
Use of Third‑Party Tools & Responsibility
The Oracle Table Method and related programs introduce you to third‑party platforms, tools, and software. These include but are not limited to:
Strategic AI platforms: ChatGPT, Claude, Gemini, Perplexity, NotebookLM, Microsoft Copilot.
Creative AI platforms: Canva, ElevenLabs, HeyGen, Squarespace, Google AI Studio, Adobe Firefly.
Deployment and build platforms: Lovable, Custom GPTs (OpenAI), Google Gems, Claude Projects.
Developer and coding tools (not covered in curriculum but may be used independently): Claude Code, GitHub, GitHub Copilot, OpenAI Codex, Gemini Code Assist, Cursor, Replit, Windsurf, and other AI‑assisted development environments.
These platforms are independently owned and operated. Kenekts is not affiliated with, endorsed by, or partnered with any of these providers unless otherwise stated. This list is not exhaustive—students may encounter additional tools as AI platforms evolve, and all such tools are subject to these Terms.
Platform Costs
Your program fee covers the Kenekts curriculum, methodology, and course materials only. It does not include the cost of any third‑party platform subscriptions, upgrades, or premium features. Many platforms offer free tiers sufficient for course work, but any decisions to upgrade, purchase, or subscribe to paid versions are solely your responsibility. Kenekts does not cover software or subscription costs.
Platform Changes and Availability
AI platforms evolve rapidly. Features, interfaces, pricing, and availability may change without notice. If a third‑party platform becomes unavailable, discontinues a feature, or changes its functionality:
Kenekts will provide alternative guidance where possible.
We do not guarantee that all course content will reflect the most current version of every platform at all times.
We do not guarantee the continued availability of any specific tool or feature.
Account Responsibility
You are solely responsible for creating, managing, and maintaining your accounts on all third‑party platforms. This includes complying with each platform’s terms of service, acceptable use policies, and community guidelines. If your account is suspended, terminated, or restricted by a third‑party platform for any reason, Kenekts is not responsible and is not obligated to provide a refund or alternative access.
Data and Privacy on Third‑Party Platforms
Each third‑party platform has its own privacy policy, data retention practices, and terms governing how your inputs are stored, processed, and used. Kenekts is not responsible for the data‑handling practices of any third‑party platform. You are solely responsible for reviewing each platform’s privacy policy and for any data—including personal, confidential, or proprietary information—that you choose to upload, input, or share with these tools.
Misuse of Platform Capabilities
Some platforms introduced during the program offer powerful capabilities including voice cloning, digital avatar creation, image generation, automated content production, custom AI agent deployment, and AI‑assisted code generation. You are solely responsible for using these capabilities ethically and lawfully. Kenekts is not liable for any misuse of third‑party platform capabilities, including but not limited to:
Unauthorized voice cloning or impersonation.
Creation of misleading or deceptive content or deepfakes.
Intellectual property infringement.
Deployment of harmful, malicious, or insecure code.
Any use that violates applicable laws or a platform’s terms of service.
Technology & Availability
We strive to keep our site and Services accessible and reliable, but we cannot guarantee that they will be available at all times.
You acknowledge that:
Access may be interrupted, limited, or temporarily unavailable due to maintenance, updates, outages, or issues beyond our control.
We do not warrant that the site or Services will be error‑free, secure, or compatible with every device, browser, or network configuration.
We may modify, suspend, or discontinue any part of the Services, including specific features, modules, or integrations, at any time, with or without notice.
Where reasonable, we will make efforts to notify you of major changes and to provide alternatives or updates that maintain the overall value of your program.
Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You agree to:
Use accurate registration information and keep your contact details up to date.
Not share your login credentials or grant access to your account to anyone else.
Notify us promptly at hellothere@kenekts.com if you suspect unauthorized access or a security issue.
We reserve the right to disable accounts or require password resets where we detect suspicious activity.
Live Events & Responsible Participation
Some Kenekts experiences are designed for adult audiences and rated PG‑13. These sessions may include informal, lightly irreverent conversation and are intended for users 18 years and older.
While we make reasonable efforts to restrict access, we cannot guarantee that all attendees meet the age requirements. By joining, you confirm that you are of legal age to participate in adult‑oriented discussion.
You may not record, repost, distribute, or misrepresent any part of these sessions. Kenekts is not liable for how any attendee interprets, misuses, or reacts to the content shared during community or coaching events. Participation is voluntary and subject to removal at our discretion. If you violate our conduct or IP expectations in live or recorded spaces, we may remove your access to those spaces without refund.
Nature of Services Disclaimer
Educational Program, Not Professional Advice
The Oracle Table Method and all Kenekts programs, courses, Tracks, Coaching Sessions, and materials are educational and informational in nature only. Nothing provided through our programs constitutes or substitutes for:
Licensed professional counseling, therapy, or psychological services.
Medical, psychiatric, or mental health diagnosis or treatment.
Legal advice or legal representation.
Financial planning, investment advice, or tax guidance.
Licensed career counseling or HR advisory services.
Our Coaching Sessions are educational coaching, not licensed therapeutic or clinical services. Our coaches are not acting as licensed therapists, psychologists, psychiatrists, social workers, or counselors. Coaching is not a substitute for professional mental health care or medical care.
Self‑Reflection and Emotional Response
The Oracle Table methodology involves deep self‑reflection, identity exploration, career assessment, and professional positioning work. This type of introspective work may surface strong emotions, including anxiety, frustration, self‑doubt, grief, or feelings of being overwhelmed. This is a natural part of growth and transformation.
However, if at any point during or after the program you experience persistent emotional distress, symptoms of depression, anxiety, panic, psychosis, dissociation, suicidal thoughts, or any mental health crisis, please seek professional help immediately. Our programs are not designed to address, diagnose, or treat mental health conditions.

Assumption of Responsibility
By enrolling in any Kenekts program, you acknowledge that:
You are responsible for your own emotional and psychological wellbeing.
You will seek appropriate professional help if needed.
You understand that educational coaching is not therapy or medical care.
You will not hold Kenekts liable for emotional or psychological responses that arise from self‑reflection and professional development work.
You are in a stable mental and emotional state sufficient to engage in introspective professional development work.
If you are currently in a mental health crisis or under the active care of a mental health professional for a condition that may be affected by intensive self‑reflection work, we strongly recommend consulting your provider before enrolling.
Results Disclaimer
We make no guarantees about your outcomes. We provide education, tools, and support, but your results depend on your effort, timing, industry, risk tolerance, and unique circumstances.
Any examples of results shared in our marketing or course materials are illustrative and not promises of specific outcomes. Individual results will vary.
Termination & Suspension
We may, in our sole discretion, suspend or terminate your access to the site, courses, communities, or Services, in whole or in part, without refund (except where required by law) if:
You fail to pay any amounts due, or your payment method fails and is not promptly updated.
You violate these Terms, including our Intellectual Property or Community & Conduct provisions.
You misuse AI tools in ways that are unlawful, unethical, or materially contrary to our Responsible Use expectations.
You engage in harassment, hate speech, disruptive behavior, or conduct that harms other participants or the Kenekts community.
We are required to do so by law or by a court or governmental order.
Upon termination:
Your right to access the Services and content will stop.
Certain provisions of these Terms will continue to apply, including payment obligations, intellectual property rights, confidentiality, limitations of liability, disclaimers, and dispute resolution.
You may also choose to stop using our Services at any time. If you stop using a paid program outside of the applicable refund window, you will not be entitled to a refund.
International Users & Consumer Rights
Our Services may be accessed by users from around the world. Kenekts is a U.S. company based in Georgia.
These Terms are governed by the laws of the State of Georgia and the United States, without regard to conflict‑of‑law principles, as described below in the Governing Law and Dispute Resolution section.
If you are a consumer residing outside the United States, you may also benefit from mandatory provisions of consumer protection law in your country of residence. Nothing in these Terms—including the governing law and dispute resolution provisions—limits your rights under such mandatory laws to the extent they cannot be waived by contract.
You are responsible for ensuring that your use of our Services complies with the laws and regulations applicable in your country or region.
Copyright Complaints & DMCA Policy
We respect the intellectual property rights of others and expect our users to do the same.
If you believe that any content on our site or in our Services infringes your copyright, you may submit a notification to us at hellothere@kenekts.com with the subject line “Copyright Complaint.” Your notice should include:
Your name, address, telephone number, and email address.
A description of the copyrighted work that you claim has been infringed.
A description of the material you claim is infringing and where it is located.
A statement that you have a good‑faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
Your physical or electronic signature.
We may remove or disable access to material alleged to be infringing and may terminate access for users who are repeat infringers where appropriate.
Limitation of Liability
To the fullest extent permitted by law:

This includes damages arising from the use or misuse of AI agents, configurations, or outputs created during or after the program, or from reliance on any educational or informational content we provide.
Our total liability for any claim arising out of or relating to the Services or these Terms will not exceed the amount you paid to us for the specific program or Service at issue in the 6 months preceding the event giving rise to the claim.

Arbitration Agreement
If a dispute arises between you and Kenekts relating to these Terms or the Services, you agree to first attempt to resolve the matter informally by contacting us at hellothere@kenekts.com.
If we cannot resolve the dispute informally, you agree that the dispute will be resolved through binding arbitration in Brookhaven, Georgia, administered by a recognized arbitration provider, and not in court, except for claims that may be brought in small claims court or where applicable law does not allow arbitration of certain consumer disputes.
You and Kenekts agree that:
Any arbitration will be conducted on an individual basis, and not as a class, collective, or representative action.
You waive any right to participate in a class action, class arbitration, or representative proceeding against Kenekts.
To the extent any claim is not subject to arbitration, you and Kenekts waive any right to a jury trial in any court proceeding.
The arbitrator will have the authority to decide issues of arbitrability and the scope of this Arbitration Agreement, subject to applicable law.
If you are a consumer residing in a jurisdiction where this Arbitration Agreement or class action waiver is not enforceable, some or all of this section may not apply to you, and you may have the right to bring claims in your local courts.
